The case of Rumen Radev's resignation will be decided within a few days. This was stated to Nova TV by the President of the Constitutional Court, Pavlina Panova, who is also the rapporteur on the initiated case No. 3.
She explained that this case does not reveal any particular and factual legal complexity. It is different from the cases that the Constitutional Court usually considers. There is no admissibility phase and no opinions are requested, news.bg recalled.
In his resignation, the president does not state reasons, but states that he has already done so in his address to the people.
Panova pointed out that the president continues to be president until the Constitutional Court issues a decision announcing the suspension of his powers. From this moment - from the date of the decision, the head of state will no longer hold office. According to her, with such a resignation, a hearing of Radev before the Constitutional Court is not required, unlike the impeachment procedure, when this is mandatory.
Only after the magistrates' ruling will Rumen Radev officially cease to be the president of the country. He is officially the first head of state to resign from this post who can enter real politics before his term expires.
Now attention is focused on Iliyana Yotova. If the resignation is accepted, the vice president will complete the president's term. She will go down in history as the first female president of Bulgaria and the first female supreme commander-in-chief of the Bulgarian armed forces.
"The vice president, by virtue of the Constitution itself, will become president and there is no need for a court act to establish this circumstance. The general opinion of the court is that Ms. Yotova will most likely not have to take the oath again, because the transition from one capacity to another occurs by virtue of the Constitution, and not by virtue of any choice," Panova explained.
If Yotova takes the presidency, she will join the women in the highest positions in the state.
"The Speaker of the National Assembly is a woman, the president is also expected to be a woman. The Chairperson of the Constitutional Court is also a woman. The Chairperson of the Supreme Court, as has never happened before, is a woman. I think this should not surprise anyone, because both globally and in Bulgaria, women have proven themselves to be very good professionals," Panova pointed out.
