The proposal and efforts of the acting minister of justice for the SJC to elect a new acting prosecutor general deserve public support. This opinion was expressed by former justice minister Anton Stankov on BNT.
"There is a clearly outlined problem, defined by the ruling of the Supreme Court of Cassation, and subsequently by other courts in the country, that the acting prosecutor general is illegitimate. So Minister Yankulov is acting absolutely correctly and adequately", Stankov also pointed out.
He explained that the basis of the problems lies in "incompetent" legislation. "The very fact that this norm allows for interpretation in one way or another speaks volumes", he believes.
The former justice minister said he was not optimistic about the upcoming meeting of the Supreme Judicial Council on Thursday. "I assume that it will be defeated for procedural reasons, but at least it should be tried", Stankov noted.
According to him, the main obligation of the caretaker government is to ensure the holding of elections. He stressed, however, that in Bulgaria there is no law on the Council of Ministers.
"It is high time we had a law on the Council of Ministers that would say what it can do. The Constitution lists functions, but for example, it needs to be clarified whether a caretaker government can propose a new structure for the Council of Ministers. I am referring to the Deputy Prime Minister for Fair Elections. There is no regulation for this", Stankov explained.
He added that he was surprised by the change of all regional governors, which took place yesterday. He is categorical that people should be motivated to work for the state, and not be fired and purged when a new government comes to power.
