Anton Stankov: A clear gap is emerging between the court and the prosecution - 1

I welcome the efforts of the Minister of Justice Andrey Yankulov to remove the acting prosecutor general, because they managed to define the positions in this dispute, which is a significant step forward, but it is unlikely that an appeal against the decision of the Prosecutor's College will have any effect. This was stated by the former Minister of Justice Anton Stankov in the program “Offensive with Lyubo Ognyanov“ on NOVA NEWS.

According to him, Borislav Sarafov can perform the functions of the prosecutor general until the election of a new prosecutor general. "This is my interpretation of the law. The Supreme Court of Cassation accepts a completely different interpretation that the mandate has expired," he pointed out and added that the norm allows for an ambiguous interpretation, which in itself indicates that it is written inaccurately.

Stankov also commented that the root of the problem lies in the National Assembly, because it cannot elect a new SJC, which can elect a new prosecutor general. "A clear gap is emerging between the court and the prosecutor's office, which poses a much deeper political question. If we have a politicized prosecutor's office, isn't it high time we defined the politicization of the prosecutor's office?", he asked.

"The Constitutional Court is actually a political body. This delay in pronouncing judgments also delays political processes. I cannot predict what the decision will be," the former Minister of Justice also said.

He also indicated that he is a supporter of the idea of convening a new Grand National Assembly to change the architecture of the judiciary, as well as to discuss the problems in the presidential administration.

Regarding Bulgarian European Prosecutor Teodora Georgieva, Stankov stated that he in no way excuses her for the contacts and meetings she has had. In his words, the signal of threats looks like revenge. "She defends herself through attack," said the former Minister of Justice.
