SJC refuses to dismiss Borislav Sarafov despite Constitutional Court decision  - 1

The Prosecutorial College of the Supreme Judicial Council (SJC) categorically refused to dismiss Borislav Sarafov from the post of acting (acting) Prosecutor General. The decision of the personnel officers comes just a day after the Constitutional Court (SC) ruled that temporary leaders in the judiciary cannot hold their positions for an unlimited period. The news of the refusal was announced by Deputy Minister of Justice Tanya Radulovska immediately after the end of today's session.

The Prosecutorial College was expected to comply with yesterday's interpretative decision of the supreme judges, which confirmed the 6-month legal limit for acting presidents of the supreme courts and the Prosecutor General. This term for Borislav Sarafov expired in the summer of 2025.

According to the Ministry of Justice, the Constitutional Court's decision is unambiguous and puts an end to the legal ambiguity regarding the indefinite stay at the top of the state prosecution. However, the magistrates of the Supreme Judicial Council have made a different reading of the situation and have preserved the status quo.

Even before the start of the session, Tanya Radulovska emphasized that the personnel officers are obliged to implement the Constitutional Court's decree immediately. She specified that despite the unanimous decision of the judges, the majority in the Constitutional Court considered it sufficient to declare that the introduced legal restriction does not contradict the basic law.

"If they do not interpret the Constitutional Court's decision in the same way that everyone else interprets it, in this case we will have to make a request again", Tanya Radulovska was categorical after the college's vote.

The Ministry of Justice has already stated that it will not give up its attempts to remove the acting Prosecutor General, which portends a continuation of the institutional crisis between the executive branch and the prosecutor's office.
