MFA: Appeals Court in North Macedonia confirmed the ban on Iva Mihaylova receiving treatment in Bulgaria - 1

The Appeals Court in Ship confirmed the decision of the Basic Court - Kochani, which denied Iva Mihaylova the opportunity to undergo the necessary treatment in Bulgaria, the native MFA announced.

The court's decision is dated August 20. The ministry emphasizes that it is particularly disturbing that when issuing the refusal, the necessary importance was clearly not given to the conclusions of the competent local health institution regarding the severity of Mihaylova's condition, as well as to the treatment prescribed to her and the fact that it cannot be provided in North Macedonia.

"The necessary medical intervention does not constitute optional treatment or a procedure undertaken at the patient's request. It has been determined by specialists in Bulgaria and North Macedonia as a necessary part of the treatment of Iva's serious condition. It should be carried out in order to prevent further deterioration of the health of the young Macedonian Bulgarian, including the occurrence of irreversible consequences," the Ministry of Foreign Affairs emphasizes.

They also add that an inhumane approach is particularly perplexing, in which the need for treatment is questioned due to the lack of evidence that the most serious possible consequences have already occurred.

The Ministry emphasizes that the point of timely treatment is precisely to prevent the occurrence of these consequences, and not to wait for them to materialize so that a court can recognize the existence of medical necessity.

The continuing delay takes on even more serious significance given the nature of Iva Mihaylova's condition and the risk that over time the opportunities for successful treatment and recovery will be limited.

Our Foreign Ministry specifies that urgent measures have already been taken within the competence of the department to protect Iva's rights. Mihailova and will continue to use all available diplomatic and legal mechanisms to ensure that she receives the necessary treatment in a timely manner.
